1. Who we are
SwissCarExport ("we", "us", the "Platform") is operated by SwissCarExport, [ADDRESS], Switzerland. These Terms govern your use of the Platform. By creating an account or using the site, you agree to them. If you do not agree, do not use the Platform.
2. What the Platform does
SwissCarExport is an online marketplace that lets sellers list used vehicles for export from Switzerland and lets buyers browse, contact sellers, and place bids. We are only an intermediary. The sale contract is concluded directly between the buyer and the seller. We are not the seller, we do not own or inspect the vehicles, and we are not a party to any transaction between users.
3. Accounts and eligibility
You must be at least 18 and provide accurate information. You are responsible for keeping your login secure and for all activity under your account. Some features (posting, messaging, bidding) require account verification, which may include uploading an identity document that our administrators review.
4. Seller obligations
Sellers must only list vehicles they are legally entitled to sell and for export from Switzerland, provide accurate descriptions and photos, and honour the terms of any sale they conclude. Sellers are solely responsible for their listings and for the condition, legality, and delivery of their vehicles.
5. Buyer obligations
Buyers are responsible for satisfying themselves about a vehicle before buying, and for all import, customs, VAT, transport, and registration requirements in the destination country. These costs and duties are not included in the listing price unless the seller states otherwise.
6. Fees and wallet
Posting a listing may require a fee, charged from your wallet balance: normal listing CHF 7.50, auction listing CHF 10.00, subject to any free promotional period we offer. Fees are shown before you publish. Except where the law requires otherwise, listing fees are non-refundable once a listing is published. We may change our fees with reasonable notice.
7. Auctions and bidding
For auction listings, a bid is a serious commitment to buy at the bid price if you win. If you place a winning bid and then fail to complete the purchase without a valid reason, we may suspend or permanently ban your account, and we may decline to let you register again. This rule is intended to protect sellers from bad-faith bidding. [Have a lawyer confirm the enforceability of permanent and cross-account bans in the markets you serve before relying on this clause.]
8. Prohibited conduct
You may not post false, misleading, illegal, or infringing content; list stolen or non-exportable vehicles; harass other users; attempt to defraud; or circumvent our fees. We may amend, reject, or remove any listing, and suspend or terminate any account, at our reasonable discretion, particularly for breaches of these Terms.
9. Content you provide
You keep ownership of the content you upload but grant us a licence to display it on the Platform for the purpose of operating the service. You are responsible for having the rights to any photos or text you post.
10. Disclaimers and liability
The Platform is provided "as is". We do not guarantee the accuracy of listings, the conduct of users, or the outcome of any transaction, and we are not responsible for the vehicles sold through the Platform. To the fullest extent permitted by law, we are not liable for indirect or consequential damages arising from your use of the Platform or from dealings between users. Nothing in these Terms excludes liability that cannot be excluded under Swiss law or mandatory consumer-protection law that applies to you.
11. Consumers in the EU
If you are a consumer in the EU, mandatory consumer-protection rules in your country may give you additional rights, including, in some cases, a 14-day right to withdraw from paid services bought from us. Those rights are not affected by these Terms.
12. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms or where required by law.
13. Governing law
These Terms are governed by Swiss law, and the courts of [YOUR CANTON], Switzerland have jurisdiction, unless mandatory law in your country of residence provides otherwise.
14. Changes
We may update these Terms. We will post the new version with an updated date and, for significant changes, notify you. Continued use after changes means you accept them.
